Covington wins appeal

After an excavator (installing natural gas line) struck and damaged a client’s line approximately 14 times, then refused to compensate the damages, Dan Covington of Anderson & Byrd, tried the case in the District Court and prevailed.  The excavator appealed, but the Court of Appeals of Kansas has now fully affirmed in favor of Anderson & Byrd’s client.  Full text of the opinion is here:  RWD vs. Miller.

Covington wins negligence action

Daniel D. Covington, represented the owner of a water pipeline which was contacted and damaged by a contractor approximately twenty times over an eleven-mile stretch of county road. After a full day of evidence and argument, the Court found the contractor negligent, and Dan’s clients were awarded judgment and damages for parts, labor, and water loss for all but two of the incidents.
